These terms explain what TripAtlas does, what you are responsible for as a traveler, and the limits of the service.
Agreement to these terms
By using TripAtlas, you agree to these Terms of Use. If you do not agree, please do not use the app.
What TripAtlas does
TripAtlas helps you plan trips. It provides itinerary suggestions, places, maps, and tools to organize your travel.
TripAtlas does not replace official travel, safety, legal, visa, health, airline, hotel, or transportation information. Always confirm important details with official sources.
Your responsibility
You are responsible for the decisions you make while traveling, including to:
- Confirm opening hours, reservations, and tickets.
- Check travel restrictions and entry requirements.
- Check visa and passport requirements.
- Confirm transportation times and routes.
- Make safe choices while traveling.
- Follow local laws and regulations.
Your account
Some features require an account. You are responsible for keeping your sign-in secure and for activity that happens under your account.
Pricing, subscriptions, and purchases
TripAtlas offers a free tier, optional one-time trip purchases, optional monthly or yearly subscriptions, and add-ons. Where a paid plan or purchase is offered, it is sold and processed through the Apple App Store or Google Play and is subject to their terms.
- Prices, plans, features, included limits, add-ons, and free-tier allowances may change at any time at our sole discretion, and may be introduced, adjusted, or discontinued without prior individual notice.
- The price you pay and the currency you are charged in are set and displayed by your App Store or Google Play account and depend on your store country or region. They may differ from amounts shown elsewhere, including on our website, and may change with store, regional, tax, or exchange-rate updates.
- Any applicable taxes, fees, and currency-conversion charges are determined by the store and your payment provider and are your responsibility.
- Subscriptions renew automatically for the same period at the then-current price until you cancel. Where a price increase requires it, the store will handle any notice or consent before the next renewal.
- You can manage, upgrade, downgrade, or cancel a subscription through your Apple or Google account. Cancellation takes effect at the end of the current billing period.
- Except where required by applicable law or by the store's own policies, all payments are non-refundable, and partial periods, unused allowances, and one-time purchases are not refundable or transferable.
- Paid access depends on a valid, confirmed subscription or purchase status. Eligibility for the free tier, trials, and promotional pricing is determined by us and may change.
- A price change applies to billing periods that begin after it takes effect. Continuing to use a paid plan after a change takes effect means you accept the new price.
Acceptable use
To keep TripAtlas safe and reliable, you agree not to:
- Misuse, disrupt, or overload the service.
- Attempt to access another person's account.
- Scrape, copy, or harvest content at scale.
- Reverse engineer the app except where the law expressly allows it.
- Upload unlawful, harmful, or infringing content.
- Use TripAtlas for any illegal activity.
Travel information disclaimer
Travel information changes often. Maps, weather, availability, prices, and opening hours may be inaccurate or out of date. Please verify critical details directly with official sources before you rely on them.
AI suggestions disclaimer
Automated suggestions may be incomplete or inaccurate. Review your plan before relying on it. TripAtlas does not guarantee that every recommendation is suitable, available, open, or safe.
Location, maps, and third-party services
Parts of the experience are powered by third-party services, such as maps, payments, sign-in, and hosting. Your use of those features may also be subject to the terms of the companies that provide them.
Your content
Trip notes, saved places, preferences, and other details you add remain yours. You are responsible for the content you enter, and you grant TripAtlas permission to use it to provide the planning features you request.
Intellectual property
The TripAtlas name, design, and software are owned by TripAtlas and protected by applicable law. These terms do not grant you any right to use TripAtlas branding without permission.
Termination
We may limit or end access to TripAtlas if these terms are violated or to protect the service and its users.
Disclaimer of warranties
TripAtlas is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, to the fullest extent permitted by law. This includes, without limitation, any implied warranties of merchantability, fitness for a particular purpose, accuracy, title, and non-infringement.
We do not warrant that the app, or any suggestion, place, map, price, or availability it shows, will be accurate, complete, current, uninterrupted, error-free, or suitable for your trip. You use TripAtlas, and make every travel decision, at your own risk.
Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless TripAtlas, together with its owners, team, and service providers, from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, that arise from or relate to your use of the app, the content you enter, your travel decisions, or your breach of these terms or of any law or third-party right.
Limitation of liability
TripAtlas is provided on an as-is basis. To the maximum extent permitted by law, TripAtlas and its owners, team, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, bookings, money, time, or enjoyment, arising from or relating to your use of the app, the suggestions it provides, travel information it shows, or any travel decision you make.
To the maximum extent permitted by law, our total liability for all claims relating to TripAtlas will not exceed the greater of the amount you paid us for the app in the twelve months before the claim, or ten U.S. dollars.
Some places do not allow certain limitations or exclusions of liability, so parts of this section may not apply to you. In that case, our liability is limited to the smallest amount permitted by applicable law.
Governing law and disputes
These terms, and any dispute arising from them or from your use of TripAtlas, are governed by the laws that apply where TripAtlas is established, without regard to conflict-of-law rules, except where mandatory local consumer-protection law gives you stronger rights.
To the maximum extent permitted by law, any dispute will be resolved on an individual basis, and you and TripAtlas each waive any right to bring or take part in a class, collective, or representative action.
Changes to these terms
We may update these terms, including pricing and plan terms, at any time. When we do, we will post the updated version here with a new effective date, and your continued use of TripAtlas means you accept the updated terms.
